California Drug Possession Laws
In California, you cannot get arrested for possession of less than one ounce (28.5 grams) of marijuana, which is a misdemeanor offense. Larger amounts may involve jail time. And police might try to get you for "intent to sell," which is a felony and requires jail time. At Traback & Du Bois, we have a comprehensive practice in drug crime defense, and experience in getting charges reduced.
Often, our lawyers have been able to get cases thrown out of court entirely. For example, in every case, our attorneys undertake rigorous investigation to see if police used illegal search and seizure techniques. If so, we may be able to get our clients acquitted.
Even if an acquittal is not possible, our marijuana possession defense attorneys can often help people get treatment instead of jail. According to California Proposition 35, if it is your first or second possession-only charge, you can avoid jail by demanding drug treatment. After completing the program, your conviction is erased forever.
Sympathetic to Compassionate Use of Marijuana
Frankly, the lawyers and staff of Traback & Du Bois are not fans of American drug policy. Too many harmless people suffer severe punishments for committing victimless crimes. As strong advocates of the idea of "compassionate use of marijuana," we work hard to keep those accused of pot possession away from unnecessary punishments
